Linden <br /> July 28 , 1994 <br /> Page 9 <br /> Summary <br /> Resources has two main concerns : (i) that the Division is <br /> erroneously invoking the Procurement Code, which will result in <br /> unnecessary delay and unnecessary expense in carrying out the <br /> project; and (ii) that the Division intends to deviate from the <br /> scope of reclamation as defined by the approved reclamation plan, <br /> in a manner which will add expense to the project . <br /> Resources wants to see reclamation of the mine performed <br /> responsibly but at a reasonable cost . Resources has gone to great <br /> lengths to confirm a Chapter 11 Plan which provides sufficient <br /> funds to carry out reclamation according to the terms of the <br /> approved reclamation plan, and to reserve equipment which permits <br /> savings to be realized. <br /> Resources was prepared, and remains prepared, to carry <br /> out the reclamation project by procuring contracts in its own name, <br /> expending the funds provided under the Chapter 11 Plan in the <br /> manner previously discussed with the Division. Resources requests <br /> that the Attorney General and the Division reconsider the decision <br /> to procure contracts directly by the Division pursuant to the terms <br /> of the Procurement Code . <br /> If the Division insists on carrying out the reclamation <br /> project by procuring contracts in its own name, Resources needs to <br /> be consulted in advance by the Division, just as Resources would <br /> have consulted the Division in advance about contracts which it was <br /> going to procure . <br /> Resources hereby requests a meeting with you and the <br /> Division at your earliest convenience to discuss these concerns . <br /> ;; truly y urs, <br /> es B.
