SECOND CLAIM FOR RELIEF <br /> 10. Plaintiff Ralph A. Harker realleges the allegations <br /> contained in paragraphs 1 through 7 hereof. <br /> 11. As a result of its failure to pay according to the terms <br /> of the note, Resources is liable to Ralph A. Harker in an amount <br /> to he determined at trial, but in excess of $350, 000. <br /> WHEREFORE, Plaintiff Ralph A. Harker demands judgment against <br /> Mid-Ccntinent Resources, Inc. in an amount to be determined at <br /> trial, but in excess of $350, 000, together with interest, costs, <br /> and disbursements, including reasonable attorneys fees, and for <br /> such other and further relief as to the Court seems proper and <br /> jus-:;. <br /> THIRD CLAIM FOR RELIEF <br /> 12 . Plaintiff Jeanette Howcroft realleges the allegations <br /> contained in paragraphs 1 through 7 hereof. <br /> 13 . As a result of its failure to pay according to the terms <br /> of the note, Resources is liable to Jeanette Howcroft in an amount <br /> to be determined at trial, but in excess of $350, 000. <br /> WHEREFORE, Plaintiff Jeanette Howcroft demands judgment <br /> against Mid-Continent Resources, Inc . in an amount to be <br /> deterrined at trial, but in excess of $350, 000, together with <br /> interest, costs, and disbursements, including reasonable <br /> attorneys fees, and for such other and further relief as to the <br /> Court seems proper and just. <br /> FCJRTH CLAIM FOR RELIEF <br /> lc. Plaintiff Paul P. Harker realleges the allegations <br /> contained in paragraphs 1 through 7 hereof. <br /> 15 . In addition to the execution of a note payable to Paul <br /> Harker, Resources also executed two notes payable to Ralph <br /> Harker, Joseph Harker and The Idaho First National Bank, as <br /> Trustees of the Paul P. Harker Trust ( "Harker Trust Notes" ) . The <br /> trust was subsequently terminated and the Harker Trust Notes were <br /> subsequently aZsicned to Paul Harker. <br /> 16. As a result of its failure to pay according to the terms <br /> of the notes, Resources is liable to Paul P.
