I wanted to supplement the plan with a few <br /> comments and enclosures. <br /> First, I want to apologize for not circulating the Plan <br /> prior to filing. My schedule simply did not permit me to <br /> complete the draft in time for review in advance -- even as it <br /> was, I was two days late on the Court's deadline (which I <br /> informally cleared with the moving party, the U.S. Trustee) . <br /> Plans may be modified freely until, confirmation, and if <br /> my drafting does not reflect prior understandings or has <br /> unearthed a problem which was not previously considered, T <br /> suggest we work out any remaining issues now. <br /> Resourcea itself anticipates the need for some <br /> revisions or clarifications to the Plan as filed. Most of these <br /> clarifications pertain to arsine reclamation. My memorandum <br /> regarding the Plan, circulated on May 17, called for a <br /> "Reclamation Trust" which would be funded by the Rockdust Plant <br /> and augmented by cash transfers from the Creditors' Trust. The <br /> "Reclamation Trust" evolved into the "Reclamation Account" <br /> following discussions which I had with Frank Johnson. <br />
