(ii) The Environmental Trustee may enter into <br />contracts as necessary to carry out the purposes of <br />the Environmental Trust. . The Environmental Trustee <br />also may engage such legal or other services <br />necessary to carrying out the purposes of the <br />Environmental Trust. <br />(iii) ' The Environmental Trustee' shall make <br />reasonable efforts to coordinate the activities of <br />the Environmental Trust with governmental entities <br />having regulatory responsibilities. - To <br />this- end,. the .Environmental. Trustee shah. ' <br />reasonable efforts to coordinate the activities of <br />the.. Environmental Trust with the reclamation <br />activities.of the DMG and OSM. The Environmental <br />Trustee :. shall report in writing to the DMG' and .the <br />OSM- .regarding' the reclamation activities of..the <br />Environmental.Trust, quarterly or more often to the <br />extent requested by either the: DMG-or- the OSM, and <br />to designee of the State of Colorado regarding <br />other environmental remediation, quarterly or.more <br />often'. to: the:.exte#it. requested by such designee.: <br />(a.v) The-.:Eriv,ironmentaI.'•Trustee shall be. 'entitled <br />to reasonable compensation for services performed; <br />and . to. the reimbursement - of .actual and :.reasonable <br />expenses incurred - -on behalf .: of the Environmental <br />Trust . :.. <br />(v ::'- In the '.:: event -. .of resignation . of the <br />Environmental Trustee, a successor shall be <br />selected by the Debtor. <br />6.3.4 Exculpation. Neither the Environmental Trustee <br />nor his officers, directors, employees, agents, and <br />contractors :shall- become personally liable as a :result of <br />any act or :omission in carrying out the Reclamation Plan <br />and :other..environtai remediation or in spending the <br />funds in the Environmental Trust, except for such 'acts or <br />omissions :: as shall constitute misfeasance gross <br />negligence, <' or willful disregard of duties.
