(Cotter) and the Water <br />Quality Control Division (Division), the temporary diversion structure deadline contained in the <br />above referenced order was extended from January 31, 2012 to April 12, 2012. The diversion <br />structure became operational on April 10, 2012 and continues in operation. <br />The above referenced order contained a requirement in Paragraph 32 as follows: <br />Paragraph 32. Cotter shall perform a detailed evaluation of the alluvial groundwater <br />capture and treatment system implemented at the Facility to identify possible <br />enhancements that could result in more efficient and /or complete capture and <br />treatment of contaminated groundwater at the Facility. The evaluation should <br />include, at a minimum, a review of possible enhancements and /or alterations that may <br />become necessary or warranted as a result of the installation of the temporary <br />diversion structure required by paragraph 30, above, and upon the aggressive removal <br />and /or containment of pollutant source material required by paragraph 31 above. <br />Within two hundred and ten (210) calendar days of the dated of this amendment <br />[April 24, 2012], Cotter shall submit to the Division and DRMS a written report on <br />the findings of the evaluation and either l) a written plan and time schedule for the <br />implementation of the enhancements and /or alterations to the alluvial capture system, <br />or 2) a justification for why the enhancements and /or alterations are not necessary or <br />warranted.... <br />Cotter respectfully requests that the deadline, as specified in Amendment 3, Paragraph 32 of the <br />above referenced order, be extended by the same length of time as the amount of time for which <br />implementation of the diversion structure was extended (i.e., 72 days), resulting in a new deadline <br />of July 6, 2012. <br />Cotter Corporation Telephone (719) 275 -7413 <br />Canon City Mill, P.O.
