earlier time as might be deemed advisable in the <br /> discretion of the DMG. <br /> 6 .3 . 5 Transfer Free of Liens and Claims . Property <br /> transferred to the Reclamation Account shall be <br /> transferred free and clear of all liens and claims, <br /> except for the statutory lien of real property taxes <br /> and the Class 5 claim of the MLRB. <br /> 6. 3. 6 Reversion of Excess Funds. Any funds in the <br /> Reclamation Account in excess of costs and expenses of <br /> carrying out the Reclamation Plan shall revert to the <br /> Creditors ' Trust. <br /> 6.4 Environmental Trust. The Environmental Trust <br /> shall be established on the Effective Date in accordance with the <br /> following terms and provisions: <br /> 6 .4 . 1 Purpose of Environmental Trust. The <br /> Environmental Trust shall be used exclusively to pay <br /> the costs of environmental remediation outside the <br /> express terms of the Reclamation Plan, at the Mine <br /> Site, the Carbondale Industrial Park, and the <br /> Fabrication Shop, including such matters as removal of <br /> asbestos, underground storage tanks, and PCB- <br /> contaminated items, and monitoring and treatment of <br /> water discharging from the mine. <br /> 6.4 .2 Property transferred into Environmental Trust. <br /> The Environmental Trust shall be funded with $250, 000 <br /> to be transferred from the Creditors ' Trust in the <br /> manner described in Section 6.2 . 9. <br /> 6 .4 .3 Reversion of Excess Funds. Any funds in the <br /> Environmental Trust in excess of costs and expenses of <br /> carrying out the environmental remediation described in <br /> Section 6 .4 . 1 of the Plan shall revert to the <br /> Creditors ' Trust. <br /> 6.4 .4 Administration of Environmental Trust. The <br /> Environmental Trust shall be administered by the Debtor <br /> for the benefit of Class 6 creditors. <br /> (i) The Debtor shall be reimbursed from the <br /> Environmental Trust for actual, necessary costs <br /> and expenses of environmental remediation, but <br /> shall otherwise receive no compensation. <br /> -13- <br />
