The Debtor filed its First Amended Plan of <br /> Liquidation on October 1, 1993 . The United States Trustee has no <br /> objection to the adequacy of the Debtor's Disclosure Statement. <br /> Section 7 . 1 of the Plan states "Discharge of Debtor. Upon the <br /> Effective Date, the Debtor shall be discharged from all debts except <br /> as otherwise provided in the Plan. " The United States Trustee does <br /> not believe that this is allowed pursuant to 11 U.S.C. §1141(d) (3) . <br /> This issue and others have been discussed with counsel for the <br /> Debtor. <br /> The United States Trustee believes that it is now appropriate <br /> for the Court to set a hearing to consider the adequacy of the <br /> Debtor's Second Amended Disclosure Statement. <br /> Dated this O fi y day of 4er 1993 . <br /> Respectfully submitted, <br /> DAVID D.
