A special assessment will be requested on the two Citations (Nos. <br /> 3852089 and 3852090) for failure to comply with the orders issued <br /> at the Coal Basin and L.S. Wood Coal Mines. Furthermore, I will <br /> recommend implementation of a maximum civil penalty, under Section <br /> 110(b) of the Mine Act, for each day that a failure to correct the <br /> cited violations continues. <br /> These extreme measures are necessitated by my concern that, in the <br /> long term, the unsealed mines pose a hazard to the public and the <br /> fact that it is mandatory that these identified mines comply with <br /> the rules and regulations. Not only is it likely that explosive <br /> concentrations of methane- and oxygen-deficient atmospheres will <br /> migrate out of mine portals, but history has proven the serious <br /> consequences that may occur to unsuspecting persons who enter <br /> abandoned mines. Many fatal accidents have occurred in the past. <br /> Most of the openings in question are easily accessible by the <br /> public, and exposure is sure to occur, in time. <br /> I recognize part of the financial difficulty that faces Mid- <br /> continent Resources, Inc. , but must insist on compliance with the <br /> above-noted enforcement actions. Your immediate response to this <br /> situation may delay or terminate our planned actions under 110 (b) <br /> of the Mine Act.
