royalties due under the CFI lease to MCR for transmittal <br /> to CF&Z Steel as the same become due, subject to such <br /> offsets as may be available or because of production royalty <br /> payments. <br /> 5. In addition, Pitkin agrees to pay MCR a <br /> royalty of $0. 50 per ton on limestone rock quarried and sold <br /> from the Mid-Continent Quarry, payments to be made quarterly, <br /> within thirty (30) days after the expiration of each calendar <br /> quarter for the preceding quarter. <br /> In addition, Pitkin agrees to provide MCR' s <br /> limestone requirements (without payment of royalty to MCR) <br /> at Pitkin's cost plus 10% . <br /> 6. The parties agree to cooperate fully in <br /> securing such permit changes as shall be needed to accomplish <br /> the quarrying contemplated. MCR shall present such quotations, <br /> requests for modification and other information as may be <br /> reasonably needed to accomplish the changes required to <br /> carry out the quarrying hereby contemplated, and Pitkin will <br /> prepare and submit all such documents into Mid-Continent for <br /> processing. <br /> 7. Neither party will incur any debt or obligation <br /> to the account of the other, without prior written consent, <br /> and Pitkin shall carry- it's own liability insurance, and <br /> shall save MCR harmles$ from and on account of it's operations. <br /> 8. Pitkin shall be relieved of it's obligations <br /> hereunder in the event of force majeure conditions, hereby <br /> 3 <br />
