Box 1298 <br /> Glenwood Springs, Colorado 81602 <br /> RE: Carbondale Rock Dust Plant <br /> Dear Mr. Delaney: <br /> Over the past few months we have received correspondence from you on several <br /> occasions regarding offers to purchase the Rock Dust Plant. Each correspondence <br /> generally requests the advice of the Division regarding a proposal to purchase the plant. <br /> The Division has previously not responded to the correspondence. <br /> The Division is not in a position to offer advice regarding a potential sale, nor to accept <br /> or reject a bid. As the owner of the facility, Mid-Continent is solely responsible for <br /> making the initial decision to accept or reject an offer to purchase. <br /> The State holds a first lien on the rock dust plant for the purpose of securing <br /> reclamation of the Coal Basin Mine. Because it is clear that the sale price will be well <br /> below the amount of money necessary to reclaim the mine, the Division urges <br /> Mid-Continent to do all it can to maximize the sale price. <br /> Mid-Continent should continue to negotiate the sale of the rock dust plant. When an <br /> acceptable offer is received and Mid-Continent is inclined to agree to the proposal, a <br /> copy of the terms of the sale should be forwarded to Cheryl Linden of the Office of the <br /> Attorney General. <br /> Please contact Cheryl Linden at (303) 866-31 17 if you have questions or comments. <br /> Sincerely, <br /> Steven G.
