S. provides that any person who has or
claims an interest or a lien on any undivided or divided estate
or interest for which a tax lien has been sold may redeem such
estate or interest by paying to the treasurer his proportionate
share of the amount required to redeem the whole. The State of
Colorado holds a senior lien on the property referred as the
rockdust plant which is taxed with other property under schedule
no. 111391011. The lien is documented by Coal Reclamation Bond
secured by Deed of Trust, Reception No. 357928 , Book 661, Pages
215-17 , Garfield County Clerk and Recorder's office with certain
subsequent amendments, which are also recorded.
In lieu of foreclosure, the rockdust property has been sold in
partial satisfaction of the lien through proceedings in the
United States Bankruptcy Court for the District of Colorado, Case
No. 92-11658 PAC pursuant to an order of the Court dated June 15,
1994, wherein authorization was granted to pay the property taxes
on the property from the sale proceeds at closing, with the bal-
ance to be paid to the Division of Minerals and Geology. The
purchaser of the rockdust plant equipment is Pete Lien and Sons,
Inc.
The Division of Minerals and Geology hereby requests that the
county apportion the taxes to be paid on the rockdust property
apart from the rest of the involved property. Jean Richardson of
the County Treasurer's office stated today that such amount was
$65, 791. 42 . Once apportionment is done, please issue a redemp-
tion certificate to the Division for this property upon receipt
