BURNS, FIGA & WILL, P.C.
Cheryl Linden
June 9, 1995
Page 10
DMG Inspection Report of October 7-8. 1993:
Reclamation work has progressed nicely at the#5 Mine. There were still several
days of dozer work before final grade will be achieved. At the time of the
inspection the dozer was down but was being repaired by the time we left the
site. Following completion of grading seeding of the site will occur.
The operator had the recently approved seed mix stored at the mine office and
had already stockpiled hay mulch for use at the #5 mine. At this point it does
appear that the operator will complete reclamation actives at the#5 mine this year
as planned . . .
Around the main office/warehouse area quite a lot of work has also been
completed, including: . . . final grade of the Sutey refuse pile has been completed
plus some limited topsoil replacement.
The stabilization work has also been completed on Dutch Creek where large
riprap was placed on the cut bank below the west end of the old refuse pile. This
work was completed under the Army Corps of Engineers under a nationwide
permit and Minor Revision 43 from DMG . . .
Also during this inspection field Minor Revision 4 was issued for repair work to
commence on the Dutch Creek flume. Discussion has been ongoing for some
time about how to best repair the flume. The concrete pan had been repaired
earlier this summer but will not hold up through spring runoff as evidenced by
recent leaks. This revision will allow placement of a 9-foot diameter steel pipe
for approximately 200 feet at the lower end of the flume. A concrete support
pillar will be placed behind the current flume pillar as additional support and a
concrete bulkhead will be installed at the inlet side. Details of the structure were
revised at the site and formal submittal is due October 12, 1993. This revision
allowed initial preparation work to get underway while the final details were
completed.
DMR Inspection Report of November 2. 1993:
Over the course of the summer of 1993 a number of enforcement actions have
been issued to MCR concerning various aspects of the operation and
administration of the reclamation activities.
