and no further reclamation work was done that year, except for the ongoing salvage and portal <br /> sealing, which were carried out under previously approved contracts. <br /> 25. I took the three volumes which contain time sheets completed by the reclamation <br /> crew (during the period of time which is the basis of the Pitkin claim) to the offices of the <br /> CDMG and offered them for inspection. I met with Rich Adanich and gave him these volumes <br /> for his review. I returned to pick up these volume several hours later after Mr. Adanich had <br /> completed his review and left for the day. This occurred in October 1995. <br /> 26. I offered to set up a meeting, at CDMG's convenience, with Robert J. Delaney <br /> and Lou LaGiglia, so that any questions of CDMG concerning the Pitkin claim could be <br /> answered. Ms. Linden, the Assistant Attorney General, said she wished to defer any such <br /> meeting until after the Supplemental Objections to the claim had been filed. I have heard <br /> nothing further from CDMG concerning this offer. <br /> 27. A stipulation was reached between Resources and the Creditor's Committee on <br /> November 29, 1993, provided that payments to Pitkin would be categorized, such that funds paid <br /> Pitkin for "environmental remediation" would be credited under the Plan to the Environmental <br /> Account and funds paid for "reclamation" would be credited against the Reclamation Account <br /> under the Plan. <br /> 28. I have compiled photographs taken at the mine site during the period of time <br /> which is the subject of the Pitkin claim. The photographs have been marked as Pitkin's Exhibit <br /> B. I took these photographs or was present when they were taken and I know them to be <br /> accurate as to the condition of the site. The comments on Exhibit B were written by me and are <br /> true and correct to the best of my knowledge. <br /> 29. I helped prepare Pitkin's Exhibit A from documents maintained by Pitkin and by <br /> Resources in the ordinary course of business. All the information contained in the Exhibit is <br /> true and correct to the best of my knowledge. <br /> 30. The Notices of Violation and associated documents marked as Pitkin's exhibits <br /> were received by me on behalf of Resources and have been maintained by Resources in the <br /> ordinary course of business. <br /> 4 <br />
