7. The reclamation crew was required to receive, and did receive, annual safety <br /> training, prior to work at the mine site. This is a requirement of the federal Mine Safety and <br /> Health Administration ("MSHA"). <br /> 8. The work performed at the mine site was required, directed, monitored and <br /> regulated by the Colorado Division of Minerals and Geology ("CDMG"). <br /> 9. Reclamation of the site is governed by the reclamation plan approved in Permit <br /> C-81-017, issued by CDMG to Resources for mining and reclamation activities. <br /> 10. Some revisions to the reclamation plan and permit were approved by the CDMG. <br /> I made these revision requests on behalf of Resources, and they were issued to Resources. <br /> Work approved through these revisions was performed by the Pitkin crew using Pitkin rental <br /> equipment and Resources retained equipment and is included in the Pitkin claim. <br /> 11. Representatives of the CDMG inspected the mine site frequently. Inspection <br /> reports were provided Resources and I received them as representative of Resources. These <br /> inspections were directed principally to work being performed by the Pitkin reclamation crew, <br /> using Pitkin's rental equipment and Resources' retained equipment. <br /> 12. The CDMG issued a number of Notices of Violation which directed that work <br /> should be done at the mine site within specified, usually relatively short, time periods. These <br /> were issued to me as representative of Resources. The required abatement steps were performed <br /> by the reclamation crew, using both the Pitkin rental equipment and the Resources' retained <br /> equipment. This work is in part the basis of the Pitkin claim. <br /> 13. I spoke frequently to representatives of the CDMG concerning work at the mine <br /> which was being performed by the Pitkin crew, using equipment rented from Pitkin, as well as <br /> the Resources' owned, retained equipment. <br /> 14. At the suggestion of the CDMG, Resources retained the services of a reclamation <br /> consultant, Greg Lewicki. Mr. Lewicki spent considerable time at the mine site reviewing and <br /> giving advice as to the reclamation work then under way. Mr. Lewicki also met with CDMG <br /> representatives and prepared designs for their review and approval. <br /> 15. Due to the remote location and high elevation, the working season at the mine is <br /> quite limited. Reclamation and on-the-ground maintenance must be done in those periods of the <br /> year when the ground is clear of snow and dry. Although climatic conditions are variable, this <br /> generally limits the working season to the period of July through October for most of the mine <br /> site. <br /> 16. In September 1993, the Mined Land Reclamation Board issued an order revoking <br /> Resources' bond, but directing that Resources continue to maintain and reclaim the mine site <br /> 2 <br />
