35. Charges to Resources for fuel and maintenance costs apply only to equipment used <br /> by Resources during the time is was being rented. <br /> 36. Pitkin also advanced funds for parts, maintenance, repairs and fuel for the retained <br /> equipment owned by Resources and used for reclamation, salvage, and clean-up of Resources' <br /> properties. A monthly summary of such charges to Pitkin, for which reimbursement is <br /> requested, is included with the documentation provided in Section 3.8 of Pitkin's Exhibit A. <br /> The primary vendors include the Roaring Fork Co-op, Carbondale Auto, Loco, and Wagner <br /> Equipment. <br /> 37. An administrative charge of 15% was applied only to the gross payroll and <br /> insurance cost; otherwise, no addition or markup has been charged and only reimbursement of <br /> actual expenditures has been requested. No profit or overhead has been charged, and no charge <br /> has been added to the requested reimbursement for funds expended for purchase of goods and <br /> services on behalf of Resources. <br /> 38. Bookkeeping requirements have been a substantial burden to Pitkin in providing <br /> these services to Resources and have required considerable time, effort and some expenditure. <br /> Other than the Administrative Charge, Pitkin has requested no other payment or compensation <br /> for such effort and expenditure. <br /> 39. Different accounting methods were not used during the time period in question. <br /> The claim is based on actual payments made by Pitkin on behalf of Resources (with the <br /> exception of the 15% charge). <br /> 40. I submitted monthly bills to Resources on behalf of Pitkin for the time period at <br /> issue here and for many months before. At no time did Resources ever object to Pitkin's bills. <br /> 41. I helped prepare Pitkin's Exhibit A from documents maintained by Pitkin and by <br /> Resources in the ordinary course of business. All the information contained in the Exhibit is <br /> true and correct to the best of my knowledge. <br /> 42. I prepared the first two pages of Pitkin's Exhibit C based on Pitkin's records kept <br /> in the ordinary course of business. I provided the information to Mr. LaGiglia who prepared <br /> the backup documentation for Exhibit C. <br /> 5 <br />
