The issues raised in the administrative proceeding are raised in <br /> this complaint as claims for relief. <br /> WQCD <br /> Contest of NoV-Order, as amended, <br /> Administrative proceedings Belo► <br /> 21. The Hearing Officer, <br /> Howard Roitman <br /> Remedial Section Chief <br /> Waste Management Division <br /> Colorado Department of Health <br /> 4210 East llth Avenue <br /> Denver, CO 80220, <br /> was appointed by letter, dated July 26, 1989, from Thomas P. Looby, <br /> Assistant Director, Health and Environmental Protection, Colorado <br /> Department of Health. <br /> 22 . A prehearing conference was conducted by the Hearing <br /> Officer on December 5, 1989. A Prehearing Conference Order was <br /> entered by the Hearing Officer on December 19, 1989. Mid-Continent <br /> filed certain objections to the Order. The objections were ruled <br /> upon by the Hearing Officer at the evidentiary hearing. <br /> 23 . An evidentiary hearing in this proceeding was conducted <br /> by the Hearing Officer on January 9, 10, and 11, 1990 pursuant to <br /> paragraph 12 of the Prehearing Conference Order entered December <br /> 19 , 1989, as amended. <br /> 24. Following submission of post-hearing memoranda, the <br /> hearing officer rendered his Findings of Fact, Conclusions of Law, <br /> Ruling and Order, dated November 10, 1990. <br /> 25. Mid-Continent timely filed its exceptions to the <br /> hearing officer's findings on November 14, 1990 with J. David Holm, <br /> Director, Water Quality Control Division, Department of Health, and <br /> with the Department of Health. <br /> 26. In response to these exceptions the Department's Order <br /> Affirming Hearing Officer's Decision, dated April 16, 1991, was <br /> entered. This affirming order was not mailed until May 30, 1991. <br /> Part IV <br /> Colorado Mined Land Reclamation Act <br /> Colorado Surface Mining Reclamation Act <br /> Colorado Mined Land Reclamation Division (MLRD) <br /> 27. The activities of Mid-Continent, as an underground coal <br /> mine operator, were and are permitted under the Colorado Mined Land <br /> Mid-Continent Resources, Inc. <br /> Complaint - 5 - <br />
