10. On February 7, 1989, a representative of MLRD <br /> inspected the mine and observed a dark-colored discharge <br /> occurring from outfall 016. The effluent was sampled and <br /> analyzed according to standard test procedures. The <br /> effluent was found to contain 3350 mg/l TSS. <br /> 11. During the period between January 26 and February <br /> 7, 1989, there were no changes in the minewater handling <br /> system or minewater treatment system which would <br /> significantly alter the quality of the minewater discharge <br /> from outfall 016. <br /> NOTICE OF VIOLATION <br /> You are hereby notified that the facts stated above <br /> constitute 13 days of violation of Part IA of the permit <br /> as follows: <br /> 1. The TSS concentrations in the effluent from outfall <br /> 016 between January 26 and February 7, 1989, exceeded the <br /> daily maximum concentration allowed by the permit of 70 <br /> mg/l; <br /> The pertinent "findings of fact" and additional alleged <br /> permit violations charged in the I1-Apr-89 WQCD Amended NoV are: <br /> 12. On February 23, 1989, a representative of the <br /> Division sampled the effluent being discharged at outfall <br /> 016. The sample was analyzed according to standard test <br /> procedures and was found to contain a concentration of <br /> total suspended solids of 31,100 mg/l, a concentration of <br /> oil and grease of 54 mg/l, and a concentration of iron of <br /> 320 mg/l. <br /> 13. The sample collected on February 2, 1989, as <br /> described in paragraph 8 of the Findings of Fact, was <br /> analyzed for oil and grease and found to contain a <br /> concentration of 36 mg/l. <br /> 14. In accordance with the requirements of the permit, <br /> Mid-Continent samples and analyzes the effluent. In <br /> response to the Notice and Order, Mid-Continent submitted <br /> a report dated March 7, 1989 which included the following <br /> laboratory results of samples taken at outfall 016: <br /> Date Concentration of pollutant <br /> 1/17/89 696 mg/l Total suspended solids <br /> 1/17/89 2.5 ml/l Settleable solids <br /> 1/17/89 2. 13 mg/l Total recoverable iron <br /> NOTICE OF VIOLATION <br /> You are hereby notified that the facts stated above <br /> Mid-Continent Resources, Inc. <br /> Complaint - Endnotes - 16 - <br />
