MOUNTAIN COAL <br />COMPANYL <br />April 27, 2012 <br />Mr. Jim Stark <br />Colorado Division of Reclamation, Mining and Safety <br />Office of Mined Land Reclamation <br />1313 Sherman Street, Room 215 <br />Denver, CO 80203 <br />Re: Mountain Coal Company, LLC - West EIk Mine <br />CDRMS Permit No. C- 1980-007 <br />Subsidence Quarterly Inspection Report - First Quarter 2012 <br />Dear Mr. Stark: <br />As a brief history of mining in the current area of production, Mountain Coal Company, LLC <br />(MCC) began longwall mining the E-Seam in December 2008. Longwall Panel El was mined - <br />out by the Third Quarter of 2010 and Longwall Panel E2 by the Third Quarter of 2011. By the <br />end of the First Quarter of 2012, MCC had mined Longwall Panel E3 up to cross -cut 40. <br />During the First Quarter of 2012 the area potentially affected by subsidence from mining was <br />mostly inaccessible for the weekly and monthly inspections due to snow cover and <br />consequently, the ground surface was not visible. <br />Longwall mining did not occur within one mile of Monument Dam. Mining was within the angle <br />of draw of Forest Service Road FS711 (Dry Fork Creek Road) and Stock Ponds P30, P29, <br />and P31. Forest Service Road FS711 (Dry Fork Creek Road) and Stock Pond P30 were <br />undermined. These land features and man -made structures were inspected in the Third <br />Quarter of 2011 when road and weather conditions permitted, and these inspections will be <br />included in the Fall 2011 Semi-annual Subsidence Report. These features will be inspected <br />for post mining effects when road and weather conditions allow. It should be noted however, <br />for the period of time before snow, there were no visible signs of subsidence induced features. <br />Quarterly routine inspection reports for Monument Dam, Forest Service Roads, and Stock <br />Ponds are included with this letter. <br />Should you have any questions or need further information concerning this First Quarter 2012 <br />Report, please feel free to contact me at (970) 929 -2308. <br />Sincerely, <br />Robin J.
