Mr. Craig Lis <br />GSL Sand and Gravel SWSP <br />March 22, 2012 <br />Page 3 of 5 <br />but has not received its liner approval from DWR. Based on the Applicants statements the <br />slurry wall leaks in multiple locations and the pit has completely filled with ground water. This is <br />not in accordance with their DRMS permit reclamation requirements. At this time the Applicant <br />has not decided whether to pursue repairing the liner and selling the pit as a water storage <br />reservoir (as per their DRMS permit), to pursue an augmentation plan to cover the long term <br />depletion requirements, or to simply backfill the pit. The current financial warranty posted for <br />the site is $281,115. Due to the current condition of the pit DRMS has raised the warranty to <br />$608,600 to account for backfilling of the pit. With the next SWSP renewal request, the <br />Applicant shall demonstrate that they are in, or are diligently pursuing, compliance with their <br />DRMS permit and the requirements as described in the April 30, 2010 DRMS letter sent to all <br />gravel pit operators (attached), specifically in regards to the required financial warranty at the <br />site. <br />Conditions of Approval <br />I hereby approve this substitute water supply plan, in accordance with Section 37 -90- <br />137(11), C.R.S., subject to the following conditions: <br />1. This SWSP shall be valid for the period of November 1, 2011 through October 31, 2012, <br />unless otherwise revoked, modified, or superseded by decree. A SWSP renewal request <br />must be submitted to this office with the statutory fee (currently $257) by August <br />31, 2012. <br />2. A well permit was obtained for the current use and exposed surface area at the site in <br />accordance with §37 -90- 137(2) and (11), C.R.S., permit no. 57723 -F. <br />3. The total surface area of the groundwater exposed at the site must not exceed 15 acres <br />during the approval period of this SWSP, resulting in evaporative losses of 33.85 acre -feet <br />for this plan period. <br />4. The amount of ground water used for dust suppression at the site shall not exceed 0.11 <br />acre -feet for this plan period, and the monthly total product mined at the site shall not <br />exceed 0.49 acre -feet of water lost with the mined aggregate. This SWSP does not <br />permit any water use for dust control or aggregate production after November 2011 <br />5. Total consumption at the site must not exceed the aforementioned amounts unless an <br />amendment is made to this plan. <br />6. Approval of this plan is for the purposes as stated herein. Any additional uses of this <br />water must first be approved by this office. <br />7. All releases of replacement water must be sufficient to cover all out -of- priority depletions <br />in time, place, and amount and must be made under the direction and /or the approval of <br />the water commissioner. The release of replacement water may be aggregated to <br />maximize beneficial use. The water commissioner and /or the division engineer shall <br />determine the rate and timing of an aggregated release. <br />8. The discharge of the replacement water and dewatered water into the Ski Lake <br />should be operated in such a manner as to not cause property damage. Any <br />property damage that results from the discharge of water into the Ski Lake is solely <br />the applicant's responsibility. <br />9. All diversions shall be measured in a manner acceptable to the Division Engineer. The <br />Applicant shall install and maintain such measuring devices as required by the Division <br />Engineer for operation of this SWSP. In addition, the applicant shall maintain daily <br />records of all diversions, replacements, and the amount of water used for each particular <br />
