OPERATORS <br />SHOULD READ THE FOLLOWING PAGES CAREFULLY IN ORDER TO ASSURE COMPLIANCE <br />WITH THE TERMS OF THE PERMIT AND APPLICABLE RULES AND REGULATIONS. If a <br />Possible Violation is indicated, you will be notified under separate cover as to when the Mined Land <br />ider <br />INSPECTION TOPIC: Air Resource Protection <br />PROBLEM/POSSIBLE VIOLATION: Possible Violation: Windblown dust from approximately 400,000 cubic <br />yards of shale stockpiled on site. This is a possible violation at this time for failure to stabilize and protect all <br />affected land, including stockpiles so as to effectively control erosion pursuant to C.R.S. 34- 32.5 -116 (4) 0). <br />CORRECTIVE ACTIONS: The operator shall provide photo documentation to the Division verifying that the <br />stockpiles have been stabilized to prevent erosion from wind by the corrective action date. <br />CORRECTIVE ACTION DUE DATE: 5/31/12 <br />INSPECTION TOPIC: Backfilling & Grading <br />PROBLEM/POSSIBLE VIOLATION: Possible Violation: Approximately 400,000 cubic yards of additional <br />shale has been excavated out of one of site reservoirs, and stockpiled on site and within the floodplain. This <br />activity is not part of the currently approved mining plan. <br />CORRECTIVE ACTIONS: Detail in a required Permit Amendment how the additional 400,000cy of shale will <br />be dealt with to bring the site back into compliance with the local floodplain authority. Additional financial <br />warranty will be required to bond for removal or on -site backfill of this material as required. <br />CORRECTIVE ACTION DUE DATE: 5/31/12 <br />INSPECTION TOPIC: Gen. Compliance With Mine Plan <br />PROBLEM/POSSIBLE VIOLATION: Possible Violation: Approximately 400,000 cubic yards of additional <br />shale has been excavated out of one of site reservoirs, and stockpiled on site. This activity is not part of the <br />currently approved mining plan. The current mine plan needs to be updated and clarified pursuant to C.R.S. 34- <br />32.5 -112 (1)(c)(VI). The operator must provide sufficient information to describe or identify how the operator <br />intends to conduct the operation and reclamation. <br />CORRECTIVE ACTIONS: The operator shall submit a Permit Amendment, with the required $2,229 <br />Page 1 of 4 <br />
