The monthly distribution of <br />the values, and the lagged affects on the Arkansas River, are detailed on the attached Table 3. As <br />stated in the request letter, Thomas E. Valco owns two <br />shares of the Rocky Ford Ditch, which you have estimated yield 25.72 acre -feet annually. Valco also <br />has a 15 year lease (through June 15, 2013, extendable for one 10 year period) for 250 acre -feet per <br />year of consumable water to be obtained from the Pueblo Board of Water Works (PBWW). Valco has <br />obtained 8 common LAWMA shares which will be used to replace depletions at the Lamar East Pit. <br />These shares' allocations vary from year to year, depending on the percent set by LAWMA. For 2011, <br />the common share allocation is 100 %; therefore, the 8 common shares will yield 8 acre -feet in 2011. <br />Valco has also purchased 90 Preferred LAWMA shares yielding 90 acre -feet of water, which will be used <br />for replacement at the Lamar East Pit. Lastly, Valco will use 25 shares of the Canon City and Oil Creek <br />Ditch, which you have estimated will yield 38.34 acre -feet annually. <br />Rocky Ford Ditch credits will first be applied to depletions at the Rocky Ford Pit, which will be <br />delivered directly to the Arkansas River using the City of Aurora's augmentation station. The lagged <br />depletions at the Rocky Ford Pit will be reduced by irrigation- season credits associated with the historic <br />consumptive use of these shares, with the non - irrigation season depletions replaced with PBWW lease <br />water. The leased PBWW water may come from any available PBWW source, and the PBWW will apply <br />the appropriate transit losses from the source to the appropriate pit. You state that most likely the <br />PBWW will make releases at or below Pueblo Reservoir. Replacement using LAWMA shares will be first <br />applied at the Lamar East Pit site. The operational scenario giving monthly depletions and replacements <br />is detailed on your attached Table 5. Depletions at the Lamar East Pit site from November through <br />March shall be added to the Post -1985 depletions LAWMA is responsible for at the state line. <br />This substitute water supply plan is hereby approved pursuant to Section 37 -90- 137(11), C.R.S., <br />subject to the following conditions: <br />1. This SWSP shall be valid for the period of June 1, 2011 through May 31, 2013, unless otherwise <br />revoked, modified, or superseded by decree. Should an additional SWSP be requested, such <br />renewal request must be submitted to this office with the statutory fee of $257 per gravel pit at <br />least 45 days prior to the expiration date of this plan. <br />2. No more than 30.1 acres (14.7 acres of post -1981 exposure) of ground water may be exposed at <br />the Canon City East Pit, nor more than 47.3 acres (29.9 acres of post -1981 exposure) of ground <br />water may be exposed at the Rocky Ford East Pit nor more than 35.4 acres (22.2 acres of post - <br />1981 exposure) may be exposed at the Lamar East Pit during this plan year without first obtaining <br />an amendment to the plan.
