Berms around the active pit appeared to be stable (Photos 2 — 3). <br />Current Stipulations: <br />There are no current stipulations. <br />OBSERVATIONS <br />PERMIT #: M- 1985 -218 <br />INSPECTOR'S INITIALS: TC1 <br />INSPECTION DATE: April 10, 2012 <br />This was a Succession of Operator (SO) inspection for the purpose of determining if the current financial <br />warranty is adequate. The operator's representative (Rusty Cochran) was present for the inspection. This site is <br />located approximately nine miles east of Pueblo, in Pueblo County. The site is south of US Highway 50 on the <br />north bank of the Arkansas River. <br />Inspection: <br />The Permit sign and boundary markers were properly posted (Photo 1). The site has not been actively mined <br />for several years, but Mr. Cochran indicated stockpiled material is occasionally sold and transported offsite. <br />Protection of the Arkansas River bank was discussed and if the Operator had addressed possible stream capture <br />by the active pit. Mr. Cochran showed this inspector the U.S. Army Corps of Engineers (USACE) permit for <br />"Hard Point Protection" in the Arkansas River. The permit allows the Operator to build scour protection <br />structures, such as bendway weirs in the river to protect the river bank. <br />Records: <br />• The previous inspection was conducted 12/20/2007. <br />• Division records indicate a substitute water supply plan was approved by the Division of Water <br />Resources through March 31, 2012 for the exposed groundwater on site. <br />• The permit anniversary date is June 15. The operator is current with annual fees and reports through <br />2011. <br />• This is the third SO for the site. Lafarge SO'd the site from SO Western Mobile Southern, Inc. in 2002. <br />Bond: <br />The current $51,542 bond is inadequate to cover the cost of installing a slurry wall as proposed by the previous <br />Operator's consultant (Applegate Group, Inc) in a letter dated April 28, 2011 (see enclosure). This is cited as a <br />problem on page 1 of this inspection report. The Operator may phase in the increased bond if desired. A photo <br />of the pond is included as Photo 4. <br />Recommendations: <br />The Division recommends the following tasks be completed by the Operator: <br />1. The previous substitute water supply plan (SWSP) expired at the end of March 2012. The Operator <br />needs to renew /amend the SWSP with the Division of Water Resources. The Operator should also <br />verify all water rights necessary for the SWSP were transferred to the Operator during the transfer of the <br />property. The source of replacement water is the Arkansas Groundwater Users Association (AGUA). <br />2. The Operator shall submit a Technical Revision to the Division requesting a change to the reclamation <br />plan to include the slurry wall proposed by the Applegate Group. The lack of a permit revision for the <br />slurry wall is cited as a problem on page 1 of this inspection report. <br />3. The Operator should note that if there is no mining related activity for 180 days or more, a request for <br />Temporary Cessation should be submitted to the Division pursuant to C.R.S. 34- 32.5 -103 (11) (b). <br />Page 2 of 4 <br />
