Stone, its contractors, agents or employees, including the cost of removing such <br />hazardous material(s). <br />11. Additional Terms. <br />a. All utilities for the Premises shall be paid by Colorado Stone. <br />b. Colorado Stone shall not sublet, assign, encumber or release the Premises to any other <br />person or entity than its Affiliates. <br />c. Simultaneously with execution hereof, Colorado Stone shall designate in. writing to the <br />Town a responsible party as its contact person, whose name and address shall be set forth <br />below. <br />d. The fuel and oil to be stored shall be that for automobiles, trucks, generators and heavy <br />equipment in association with the operation of the quarry only. Such fuel and oil shall be <br />stored in proper containers that meet all governmental and industry standards. <br />e. Colorado Stone shall conduct its business so that no leakage or spills contaminate the <br />Premises. In the event that any leakage occurs on site Colorado Stones shall immediately <br />clean -up the spill; <br />f. The fuel and oil are to be stored on the surface only; no underground storage is permitted. <br />g. Colorado Stone shall have available the necessary hand -held fire extinguishers for <br />immediate use. <br />h. Colorado Stone shall notify in writing the local fire department of any situation involving <br />possible fire hazards in case they occur. Colorado Stone shall comply with all reasonable <br />requests of the fire department. <br />j• <br />i. The Building on the Premises (commonly designated as the Oil House) shall be kept <br />locked at all times except when being accessed by Colorado Stone personnel. <br />This lease shall not entitle Colorado Stone to interfere with the public access through the <br />premises to an adjoining public street or roadway. <br />k. Unless otherwise provided herein, operating hours for the loading and the unloading of <br />blocks at the Premised shall be 7:00 A.M. to 7:00 P.M. Monday through Fg r The <br />Town of Marble agrees that up to twenty (20) overtime periods which are each no more <br />than 4 hours (two periods may be combined for a maximum period of 8 hours on <br />Saturday from 9 a.m to p m.) per year provided that Colora o tone shad give the <br />Town 12 I_ ours prior written notice that an overtime period is required. An overtime <br />period shall be construed as representing a maximum of four (4) hours. There shall be Y10 <br />operations or overtime periods on Sundays. The Town of Marble may release, upon <br />Mayoral prior approval, Colorado Stone from its obligation for any one period to provide <br />a 12 hours written notice or release Colorado Stone for a longer period from its obligation <br />to comply with the restrictions contained herein in a specific instance only which release <br />shall apply for one specific overtime period. The Parties agrees that the limitations <br />provided in this paragraph shall apply only for the operations strictly related to the <br />loading and the unloading of blocks at the Premised, being understood that any other <br />operation is allowed including without any restriction any operation related' to the <br />removal of the snow. <br />3 <br />
