Response to DRMS Adequacy Review — Cotter JD -8 Mine Reclamation Plan Amendment <br />to Russ Means, lead permit specialist, who will forward the responses on to the review team <br />accordingly. <br />Please review and respond to the following issues: <br />Administrative Review: <br />(1) <br />(1) <br />(3) <br />Rule 1.6.2(e), the applicant is required to provide proof of notice to all adjacent <br />landowners identified in the amendment application. The Division has not received proof <br />of notice to the adjacent landowners. <br />Cotter response: Attachment 2 — Proof of Mailing provides copies of the certified <br />mail receipts showing to whom the notices were mailed. <br />(2) Rule 1.6.5(2), the applicant must provide proof of publication. The Division has not <br />received proof of publication. <br />Cotter response: Attachment 3 — Proof of Publication provides a copy of the <br />publication in the local newspaper. <br />Application Review: <br />Due to the age of the permit many of the exhibits were out of date and required updating. AM -01 <br />consists of these updates as well as the EPP submission. Therefore, this review encompasses <br />material required under Rules 6, Rule 3, and the requirements for the EPP under Rule 6.4.21, <br />Rule 7.3, and Rule 7.4 respectively. <br />Rule 6.2.1(2) (b), Maps and Exhibits, must be prepared and signed by a registered land <br />surveyor, professional engineer, or other qualified person. None of the maps submitted <br />by Cotter or Whetstone are signed as required. <br />Cotter response: All maps in this submittal have been signed by a professional <br />engineer or other qualified person. <br />(2) Exhibit A, the legal description must include all of the permit area. The legal descriptions <br />do identify areas as being part of the lease tract, which should be noted as the upper <br />mine area. Access roads to the upper areas are not described and must be included. <br />Cotter response: Descriptions of the access road have been included in the revised <br />Exhibit A — Legal Description (attached). <br />The last paragraph on Page A -1 should note the EPP is being prepared for the affected <br />surface areas and associated underground workings of the reclamation permit, not the <br />surface area of the claims. <br />Cotter response: The revised Exhibit A — Legal Description (attached) includes the <br />recommended change. <br />Page 5 <br />
