currently approved vegetation sampling methods, applicable to a larger surface area, to the <br />reduced 1.2 acre site. <br /> <br />NECC should evaluate the currently approved vegetation sampling methodology <br />Item 4: <br />for applicability to the current permit conditions. <br /> Please assure that any sample methodology <br />changes meet the requirements of Rule 4.15.11. Division guidelines (Guidelines regarding <br />Selected Coal Mine Bond Release Issues, 4/18/1995) may provide assistance in determining <br />appropriate sampling design for small areas. <br /> <br />The permit does not define how much topsoil is to be replaced on the reclaimed NW Ventilation <br />Shaft location. No confirmation of topsoil replacement thickness was included in the 2004 ARR. <br />No discussion of topsoil replacement was included in the SL4 application: Phase I bond Release <br />for sealing and regrading of the NW Ventilation shaft. <br /> <br />The Division requests that NECC provide documentation of the volume of topsoil <br />Item 5: <br />replaced at the NW Ventilation Shaft reclaimed pad area. (Rule 2.04.13(d)) <br /> <br />SECTION V – PERMIT VARIANCES AND SPECIFIC APPROVALS <br /> <br />There are no specific variances and approvals by the Division for the Golden Eagle Mine. <br /> <br />SECTION VI – BONDING SUMMARY <br /> <br />Reclamation costs were recalculated as part of the Midterm Review process. The reclamation <br />cost estimate generated by the Division noted that the cost to fully reclaim the remaining <br />disturbance is $37,752.37. A Phase III bond release (Sl-06) for the majority of the disturbed area <br />was approved on August 26, 2008. The approved bond amount to be held by the Division as a <br />result of SL-06 was $72,099.00 and that bond amount is the amount currently held as required by <br />the Division. This bond amount is statutorily limited by Rule 3.03.1(2) and far exceeds any <br />amount of bond that might be required should reclamation efforts at the NW-1 shaft fail or <br />abandonment of the remaining 6 water wells be required under the permit. The Division holds a <br />wire transfer cash bond in the amount of $72,099.00. <br />Golden Eagle Mine -6- 4/4/2012 <br />
