currently approved vegetation sampling methods, applicable to a larger surface area, to the
reduced 1.2 acre site.

NECC should evaluate the currently approved vegetation sampling methodology
Item 4:
for applicability to the current permit conditions.
Please assure that any sample methodology
changes meet the requirements of Rule 4.15.11. Division guidelines (Guidelines regarding
Selected Coal Mine Bond Release Issues, 4/18/1995) may provide assistance in determining
appropriate sampling design for small areas.

The permit does not define how much topsoil is to be replaced on the reclaimed NW Ventilation
Shaft location. No confirmation of topsoil replacement thickness was included in the 2004 ARR.
No discussion of topsoil replacement was included in the SL4 application: Phase I bond Release
for sealing and regrading of the NW Ventilation shaft.

The Division requests that NECC provide documentation of the volume of topsoil
Item 5:
replaced at the NW Ventilation Shaft reclaimed pad area. (Rule 2.04.13(d))

SECTION V – PERMIT VARIANCES AND SPECIFIC APPROVALS

There are no specific variances and approvals by the Division for the Golden Eagle Mine.

SECTION VI – BONDING SUMMARY

Reclamation costs were recalculated as part of the Midterm Review process. The reclamation
cost estimate generated by the Division noted that the cost to fully reclaim the remaining
disturbance is $37,752.37. A Phase III bond release (Sl-06) for the majority of the disturbed area
was approved on August 26, 2008. The approved bond amount to be held by the Division as a
result of SL-06 was $72,099.00 and that bond amount is the amount currently held as required by
the Division. This bond amount is statutorily limited by Rule 3.03.1(2) and far exceeds any
amount of bond that might be required should reclamation efforts at the NW-1 shaft fail or
abandonment of the remaining 6 water wells be required under the permit. The Division holds a
wire transfer cash bond in the amount of $72,099.00.
Golden Eagle Mine -6- 4/4/2012
