2.03.6(1) <br />2.03.6(2) <br />The Bray coal lease was terminated on a pro -rata basis during April 1997. <br />The termination applies to the unaffected acreage under the lease. The <br />lease contains approximately 11.6 disturbed acres under the mining <br />permit. In describable sections, the lands for which the Bray Coal Mining <br />Lease pertain as of April 1997 are: <br />Township 46 North, Range 15 West N.M.P.M <br />Section 33: Disturbed areas in the SW /2NW /4NE /4, SE/4NE /4, <br />W /2NW /4SE /4 <br />(2)(a) <br />The private mineral estate to be mined in the E/2 of Section 33 has <br />been severed from the private surface estate. The surface owner, <br />Bray, has supplied written consent to the extraction of coal by <br />surface mining methods by the Bray coal mining lease referenced <br />above. No additional mining is anticipated. <br />Within the permit area in Sections 5 & 32, the surface is owned by <br />Roy and Betsy Davis and the coal is owned by the BLM. The <br />applicant does not plan to mine the Federal coal. <br />2.03.7 RELATIONSHIP TO AREAS DESIGNATED UNSUITABLE FOR MINING <br />(1) The project area does not encompass any fragile or historic lands nor are <br />there any natural hazards present which would preclude mining. The <br />proposed permit area was not part of the Resource Management Plan <br />prepared by the BLM for the region. Unsuitability criteria does not apply to <br />private coal. All of the coal to be mined is private coal. <br />2.03.8 PERMIT TERM INFORMATION <br />(1) Mining activity commenced on the property in March 1992 and ceased in <br />July 1993. Approximately 111 acres of land were disturbed during active <br />mining. Additional details about the schedule of the disturbance are <br />presented in Section 2.05.3(2). <br />(2) Not applicable <br />(3) The term of the permit shall be for five years. <br />2.03 -9 August 1999 <br />
