0 2.05.3(4) Ponds, Impoundments and Diversions
Therefore, there should be no diminution of the quantity of water available to
water right holders for agricultural, industrial, recreational, or domestic uses.
e) The size of the impoundment shall be adequate for its intended purposes;
Pond B has a capacity of 8.6 acre feet or 2.8 million gallons. This capacity is
more than adequate for wildlife and cattle use.
f) The impoundment shall be suitable for the approved post- mining land use.
The post- mining land use is rangeland and wildlife habitat. The permanent
impoundment will provide an important source of water for cattle and wildlife.
In their letter dated May 10, 2010, David and Terri Andrews stated they would
perform any required maintenance on the pond after final bond release. The letter
is located in Exhibit 8.
•
TR -09 2.05 -8iii 11/2010
