Compliance With Mine Plan <br />N - Support Facilities Not On -site <br />N - Other <br />N - Special Categories Of Mining <br />N - Processing Waste <br />N - Topsoil <br />COMMENTS <br />INTROCUCTION — This was a complete inspection of the Bear No. 3 Mine conducted by Brock Bowles of <br />the Colorado Division of Reclamation, Mining and Safety on April 9, 2012. There was not a company <br />representative present for the inspection. Weather conditions were clear and warm with a light breeze and the <br />soil conditions were dry. <br />AIR RESOURCE PROTECTION — Rule 4.17: <br />There were problems with fugitive dust on site or off. Most of the site is vegetated. <br />AVAILABILITY OF RECORDS — Rule 5.02.4(1): <br />Bear No. 3 Mine records were available at the Bowie No. 2 Mine office. The required mine records were <br />available for review. See the Availability of Mine Records Checklist at the end of this report. <br />HYDROLOGIC BALANCE - Rule 4.05 Drainage Control 4.05.1, 4.05.2, 4.05.3; Siltation Structures 4.05.5, <br />4.05.6; Discharge Structures 4.05.7, 4.05.10; Diversions 4.05.4; Effluent Limits 4.05.2; Ground Water Monitoring <br />4.05.13; Surface Water Monitoring 4.05.13; Drainage — Acid and Toxic Materials 4.05.8; Impoundments 4.05.6, <br />4.05.9, Stream Buffer Zones 4.05.18: <br />The water from the hillside seep was orange in color and flowed to the treatment pond through the <br />collection ditch and underground pipe. The water level in the pond was about 6 inches below the horizontal pipe <br />(photo 1). The berm around the treatment pond appears to be stable. The treatment pond was discharging at the <br />approved NPDES discharge point and draining to the North Fork of the Gunnison River. The water was orange in <br />color. <br />The sediment pond discharge pipe needs to be cleaned and the channel below the discharge also needs to be <br />cleaned (photo 2). Presently, the channel appears to be higher than the pipe which would impede the water flow <br />from the discharge pipe.
