will require mitigation because discharge for Pond 007 will <br /> supplement the rights downstream from the pond. Hence, the <br /> augmentation plan provides water primarily to the surface <br /> rights on Calamity Draw upstream of Pond 007. Mitigation is <br /> required only during the irrigation season, or about 7 months <br /> out of 12 . Therefore, 7/12 of the pit inflow (43 .8) needs to <br /> be replenished during the irrigation season. This amount is <br /> 25.8 acre-feet. The rights that may require augmentation <br /> were determined from ground-water drawdown calculations <br /> provided by GeoTrans, Inc. <br /> In order to account for "losses" due to timing of flows <br /> and diversions, and measurement error, an administrative loss <br /> factor of 0.5 is used. Therefore, twice the augmentation <br /> amount, or 51.2 acre-feet is used to prevent impact. This <br /> excess water might be used to satisfy calls for water stored <br /> out-of-priority in the ponds depending on the location of the <br /> call and time of year. <br /> The water consumptively used by the mine, and the water <br /> for augmentation to prevent potential impact to rights caused <br /> by pit inflow will be provided from the 27 shares of <br /> Colorado Co-operative Company currently owned by Peabody. <br /> However, this will entail obtaining permission to change the <br /> use of the water to include industrial uses, and transferring <br /> water from the Second Park area (Figure 2) to the NUCLA EAST <br /> 6 <br /> GEOTRANS, INC. <br />
