As detailed in Tab 3, Attachment 3-11, Peabody has valid existing rights which allow <br /> mining activity within 100 feet within the existing Nucla Mine Permit boundary. Coal <br /> leases from D.J. and I.M. Larsen (dated 3/3/76) and San Miguel Power Association (dated <br /> 5/12/77), cover the following parcels of land which will have activity within 100 feet of <br /> County Roads 124 (A-A) and 2650: <br /> T47N, R16W <br /> Sec. 25 - SASE$ and E�SW$ <br /> Sec. 26 - WhNEk and E�NEk <br /> In addition, as shown on Exhibit 25-1 and described in Attachment 25-3 (Tab 25). Permit <br /> 48 (effective from 7/1/74 through 6/30/79) was amended on 5/28/76 as Permit 48-1A to <br /> include mining through County Roads 124 (A-A) and 2650. Mining limits for Permit 48-1A <br /> are shown on Exhibit 25-1 as the 7/l/79 coal removal line. Permit 75-36 (issued 9/20/77) <br /> extended mining activity contiguous with Permit 48-1A, mining northward through County <br /> Road 2650 through 1988. <br /> To summarize, Peabody has valid existing rights which allow mining activity within 100 <br /> feet of public roads within the existing Nucla Mine Permit Boundary by means of coal <br /> leases predating 8/3/77, and valid permits predating 8/3/77. Finally, the coal to be <br /> mined under this revision is both needed for, and immediately adjacent to, an ongoing <br /> surface coal mining operation for which valid permits were obtained prior to 8/3/77. <br /> In the Nucla East area, there exists a single lane dirt road approximately 0.57 miles long <br /> which extends to the west of West 5th Avenue (see Exhibit 12-3). This road is used by the <br /> City of Nucla for access to the city sewage lagoon and several residences who live along <br /> this road. These local residences will be relocated or alternative access will be <br /> provided as required by the Montrose County Commissioners. The Montrose County <br /> Commissioners have granted Peabody permission to temporarily close this road during mining <br /> (see Attachment K). Peabody will reclaim the road after mining and reopen the road to <br /> meet or exceed the terms of the Montrose County Road Closure Agreement (see Exhibit 20-10 <br /> for the proposed alignment). <br /> Support Facilities <br /> Buildings.
