This
is an increase of $7,500 over the $12,500 currently held by the Division. The estimate is based on
conditions observed during the latest inspection conducted on January 30, 2012. The increased
financial warranty was to be submitted to the Division on or before April 16, 2012. To date, the
Division has not received the increased financial warranty. As required by Rule 4.2.1, all financial
warranties shall be set and maintained at a level which reflects the actual current cost of fulfilling
the requirements of the Reclamation Plan.
Per our conversation on April 17, 2012, the Division has agreed to extend the submittal date of
the increased financial warranty. Please note the Permittee may be scheduled for a Formal Board
Hearing for possible revocation of the permit if the increased financial warranty has not been
submitted to the Division by May 18, 2012.
If you have any questions, please contact me (303) 866 -3567 x8116.
Sincerely,
Michael A.
