WAIVER
WHEREAS, Peabody Coal Company, a Delaware corporation with offices
at 1300 South Yale, Flagstaff, Arizona 86001, (hereinafter referred to
as "Peabody") desires to obtain from �1���

?'� tT-�c�YSsitfc Co (hereinafter referred to as the "Owner"),
as the owner of an occupied dwelling within 300 feet of the surface coal
mining operations, a waiver pursuant to the Colorado Surface Coal Mining
Reclamation Act and the rules and regulations of the Colorado Mined Land
Reclamation Board promulgated pursuant thereto, namely 2 CCR 407-2.
WHEREAS, Owner has agreed to give to Peabody a written waiver in
satisfaction of the above referenced regulation of Colorado Surface Coal
Mining Act and related rules and regulations.
NOW, THEREFORE, Owner hereby knowingly waives his/her/their legal
right to deny mining operations closer than 300 feet to any occupied
dwelling located upon the land owned by Owner, for and in consideration
of the sum of TEN DOLLARS and other good and valuable considerations the
receipt of sufficiency of which is hereby acknowledged. This waiver and
consent to coal mining operations and all related activities covers all
dwellings now and hereafter located upon the Owner's land, more -
particularly described as follows: 640 West 7th Street, Nucla, CO 81424
IN WITNESS WHEREOF, the undersigned has/executed this WAIVER as of
