WAIVER <br /> WHEREAS, Peabody Coal Company, a Delaware corporation with offices <br /> at 1300 South Yale, Flagstaff, Arizona 86001, (hereinafter referred to <br /> as "Peabody") desires to obtain from ._.:- mT� WN55, �-\,40 <br /> I L-aASS with address of110 o-yor <br /> 11S l �r1cc`IJ ST• �yc\q� /�2 ) <br /> ► .�aa(her i fter referred to as the Owners , <br /> as the owners of an occupied dwelling within 300 feet of the surface coal <br /> mining operations, a waiver pursuant to the Colorado Surface Coal Mining <br /> Reclamation Act and the rules and regulations of the Colorado Mined Land <br /> Reclamation Board promulgated pursuant thereto, namely 2 CCR 407-2. <br /> WHEREAS, Owners has agreed to give to Peabody a written waiver in <br /> satisfaction of the above referenced regulation of Colorado Surface Coal <br /> Mining Act and related rules and regulations. <br /> NOW, THEREFORE, Ownet; hereby knowingly waives his/her/their legal <br /> right to deny mining operations closer than 300 feet to any occupied <br /> dwelling located upon the land owned by Owners, for and in consideration <br /> of the sum of TEN DOLLARS and other good and valuable considerations the <br /> receipt of sufficiency of which is hereby acknowledged.
