NUCLA PR NO. 2 <br /> the mining industry, MSHA and CMLRD's Rule 4.05.6(10) only considers the <br /> active storage portion of the ponding area above the upstream toe of the <br /> embankment, or approximately elevation 5647, to the crest of the <br /> emergency spillway to be included in the 20 acre-feet criteria. The <br /> ponding area below the upstream toe of the embankment is considered <br /> incised storage capacity and would not be considered normally in a dam <br /> breach situation. For Pond 007 the incised volume is 12.12 acre-feet; <br /> therefore, the active storage area to the inlet of the emergency <br /> spillway is 31.26-12. 12 = 19.14 ac.-ft. which is less than 20 ac.-ft. <br /> In conclusion , Peabody does not think Pond 007 can be classified as a <br /> MSHA pond. <br /> Comment: <br /> 17. OSM is currently requesting two distinct spillway structures. The <br /> 007 design currently calls for a single riser which would act as <br /> both a primary and secondary spillway. You may want to revise the <br /> existing design because of these OSM requirements and to <br /> accommodate existing MSHA requirements for outflow structure <br /> design. <br /> Response: <br /> Peabody will comply with the Rules and Regulations of the Colorado Mined <br /> Land Reclamation Board for Coal Mining. Based on conversation with John <br /> Doerfer, CMLRD on 10/23/86 and subsequent discussions, Peabody was told <br /> a drop inlet spillway pipe with two separate openings for the principal <br /> and emergency spillway is acceptable as long as the spillways could pass <br /> the design storms , automatically dewater the pond after the 10-year, <br /> 24-hour storm event within a reasonable amount of time, and maintain one <br /> foot of freeboard between the 10-year, 24-hour storm event's peak stage <br /> and the inlet to the emergency spillway; thus, preventing any discharge <br /> through the emergencies spillway during the 10-year, 24-hour storm <br /> event. In accordance with Rule 4.05.6(3) , Peabody thinks Pond 007's <br /> design as shown on Exhibit 13-16 complies with this Rule and CMLRD's <br /> concerns. <br /> Secondly, Pond 007 is designed as a temporary structure which will be <br /> removed with bond release approval . The pond will be inspected <br /> quarterly for structural problems , monthly for water monitoring <br /> discharge requirements , and operations personnel will be at the mine <br /> site on a daily basis during normal operations; therefore, the chance of <br /> a problem with the spillway going undetected for an extended period is <br /> very unlikely. <br /> In addition, Dr. Richard Warner of the University of Kentucky, a noted <br /> author and lecturer on the Red Book, "Applied Hydrology and <br /> Sedimentology for Disturbed Areas ," recognizes the drop inlet spillway <br /> 22 <br />
