However, as <br />discussed in the permit document, the operation proposed by NECC produced coal in commercial <br />quantities and was located within or adjacent to an alluvial valley floor prior to August 3, 1977. <br />Therefore, operations may proceed despite their close proximity to an alluvial valley floor. <br />Exhibit 19(22) presents the sedimentation control plan. Ditch 28 has been removed in part <br />where the West DWDA will be located, and realigned to flow around the soil storage area as <br />shown on Map -14. As originally designed, D28 will flow to Containment Area No.1, as will runoff <br />from the soil storage area and sediment drying area. <br />The majority of the west DWDA and associated facilities is in area that has been previously <br />disturbed. However, there will be an additional 0.9 acres of new disturbance created in the <br />footprint of the west DWDA and a small area in the footprint of the soil stockpile. <br />A reclamation estimate is provided as Exhibit 28.
