C- 1981 -008 MR -83 17 April 2012 <br />PAR — Ben Langenfeld Page 2 of 2 <br />Rule 2.03.4(6)(a) Legal or Equitable Owners of Record of Surface Coal to be Mined <br />The former San Miguel Power Association (SMPA) parcel (-120 acres) at the NH2 mine <br />has been sold, and the application lists the new owner as "Tsawhawbitts Meadows Ranch <br />Trust ". According to the Montrose County GIS website, the parcel is owned by "4/7 <br />LLC ". Please review the current ownership of this property, to ascertain which of these <br />names is correct. <br />2. The SMPA parcels are identified in the permit text and on Map 2.03.4 -1 by the number <br />"13 ". With this revision, the text and map table have been revised to reflect the change in <br />ownership of 13. This has created a conflict with the map itself, as SMPA owns <br />additional property northeast of the NH1 permit area, which is also numbered 13. Please <br />use a separate number (perhaps "5 ") to identify the northern SMPA parcel, and add the <br />SMPA name and contact info to the text and map table. (Additionally, the County GIS <br />site indicates that the eastern "13" is now owned by Nylund. Please change the number <br />for that parcel to "60 ", if the County is correct.) <br />3. The former Benson -South parcel has been purchased by Staats. This parcel was <br />identified with a "41 ", but Benson (now "Benson Bud and Theresa Family Trust ", per the <br />County website) also owns other parcels; these are also numbered 41. Please revise the <br />number of the former Benson -South parcel to be "16 ", which is the number for Staats' <br />ownership. In addition, please restore and update Benson's information to item 41 in the <br />permit text and on the map table. <br />4. WFC has purchased the former Lloyd parcel, identified by number "42 ". I suggest <br />deleting the 42 from the table and text, and changing the number of this parcel on the <br />map to be "12 ", consistent with the other WFC parcels. <br />5. Once the map and table and permit text have been updated, please review the Surface <br />Lessee portion of the permit (pages 2.03 -20 and -21) and revise if necessary. <br />This concludes the Preliminary Adequacy Review for MR -83.
