3) Specific information required in Annual Reports: Intermittent operations must report to the Board, through
their Annual Reports: (i) the condition of the operation at the time of cessation; (ii) what specific measures
have been and will be implemented to comply with reclamation, performance standards and Environmental
Protection Plan (EPP) requirements; and (iii) plans for resumption of mining. Rule 1.13.7(a). The most recent
Annual report for your operation is not sufficient to satisfy these reporting requirements. Accordingly, you
must provide the following information to the Division on or before October 1, 2012:
a) A detailed and specific narrative description of the condition of the operation at the time it entered
IS, supplemented with maps; along with a detailed and specific narrative description of the current
condition of the operation, supplemented with maps.
b) If your mine is a Designated Mining Operation ( "DMO "): any and all documentation necessary to
comply with the EPP requirements associated with that legal designation. If your mine is not a DMO:
a detailed and specific narrative description of the measures that has been and will be implemented
to comply with reclamation and performance standards.
c) A detailed and specific narrative description of your plans for resumption of mining.
Failure to provide all required information by October 1, 2012 may result in a change in your permit status or
action to terminate the permit. If your operation is subject to the Federal District Court stay regarding the
Department of Energy's Uranium Leasing Program, you are relieved of any obligation to perform physical work on
portions of the operation covered by the stay. However, you are not relieved of the obligation to provide the
documentation and plans required herein by the October 1, 2012 deadline. If you have any questions, please
contact me for further guidance.
If you need additional information please contact me at the Division of Reclamation, Mining and Safety, Grand
Junction Field Office, 101 S. 3rd St., Suite 301, Grand Junction, Colorado 81501, or by telephone no. 970.241.1117.
Sincerely,
./
qA.41-
G. Russell Means
Environmental Protection Specialist II
Uranium DMOs received a letter from the Division dated September 30, 2011 that describes the applicable EPP
requirements. Your compliance with this letter will satisfy the requirements set forth in section 3(b) of this letter.
