2 . Grant Of Interest . For and in consideration of the payment <br /> of Ten Dollars ( $10 . 00) , the receipt and sufficiency of <br /> which is hereby expressly acknowledged by Lessor , and in <br /> further consideration of the covenants and agreements of the <br /> Lessee as herein set forth , the Lessor does hereby grant , <br /> lease , let and demise exclusively unto Lessee all coal of <br /> whatever ranks and grades and the substances contained <br /> therein or found in association therewith ( all hereinafter <br /> referred to as " Coal " ) lying within or under the following <br /> described lands ( " Property" ) located in La Plata County , <br /> Colorado , to wit : <br /> Township 34 North , Range 11 West N .M. P .M . <br /> Section 5 : E1 2 NW1 4 <br /> Township 35 North , Range 11 West , N .M. P .M. <br /> Section 32 : SE1/4 <br /> The Property shall also include all of the Coal in and under <br /> all land or interest therein owned or claimed by Lessor <br /> contiguous or appurtenant to said described lands . <br /> 3 . mining Ri hts . Lessor only owns coal rights to the Property <br /> and is not the owner of the fee surface interest in the <br /> Property . Lessor hereby grants the following rights in <br /> connection with and as part of the leasehold estate hereby <br /> granted : <br /> ( a) To enter , explore , mine and remove all coal within the <br /> Property , performing such entry , exploration , mining <br /> and removal in any manner deemed advisable or desirable <br /> by Lessee , whether by surface or underground mining and <br /> further grants to Lessee the right to use the <br /> underground ways to transport Coal from adjacent <br /> properties as long as mining operations are conducted <br /> beyond the term of the lease ; <br /> ( b) To use as much of the surface and surface resources of <br /> the Property as by Lessee may be deemed desirable or <br /> convenient in connection with the operations conducted <br /> by Lessee upon or within the Property ; <br /> (c) In the exercise of the foregoing rights , to remove coal <br /> mined from the Property and to transport the same by <br /> underground passage or surface transportation to other <br /> contiguous or nearby lands owned or leased by Lessee <br /> for storage and processing . <br /> 4 . Term . Lessor hereby grants and leases the Property to <br /> essee according to the provisions hereof for a term of <br /> ten ( 10) years from the date first shown above and for so <br /> long thereafter as coal mining operations are conducted on <br />
