Our initial review indicates that all preliminary <br /> items required by the Colorado Surface Coal Mining Reclamation Act, C.R.S. <br /> 34-33-101 et seq. have been submitted. Thus, your permit revision application <br /> has been deeme- complete for the purposes of filing on this date. All review <br /> and comment periods as provided in the Act and the Regulations promulgated <br /> thereunder initiate from this date of filing. <br /> The proposed newspaper advertisement submitted with the permit revision <br /> application has been found to be satisfactory with one exception. The <br /> advertisement needs to include a precise legal description or map which <br /> accurately depicts the permit area location and boundaries as required by Rule <br /> 2.07.3(2)(b). A revised legal description will need to be submitted prior to <br /> publication of the notice. Upon notification of acceptance of the revised <br /> description you should commence publication of this advertisement as specified <br /> in Rule 2.07.3(2) of the Regulations. Proof of the publication of the <br /> advertisement must be filed with the Division not later than four weeks after <br /> the last publication date. <br /> A copy of the permit revision application, less confidential items, must be <br /> filed for public inspection with the appropriate public office as specified by <br /> you on the permit revision application form. Any subsequent changes or <br /> additions to the permit revision application must also be made in this local <br /> government copy. <br /> The staff is currently reviewing your permit revision application to determine <br /> whether the items you have submitted are adequate in terms of meeting the <br /> requirements of the Act and Regulations. Additional information may be <br /> required for purposes of adequacy. According to the provisions of Section <br /> 34-33-118(5) of the Act, You will be notified no later than April 6, 90 of <br /> this Division's preliminary findings as to the substantive adequacy or <br /> inadequacy of your permit revision application. <br /> If you have any questions, please contact me. <br /> Sincerely, 1 <br /> Dan T.
