II. Land Use - Rules 2.04.3, 2.05.5, and 4.16 <br /> The specific findings required under this section which were made in the <br /> July, 1987 Findings Document (Renewal ) have not been modified by proposed <br /> PR No. 2 and remain applicable. <br /> The proposed operation is in compliance with the requirements of this <br /> section. <br /> III. Cultural and Historic Resources - Rules 2.04.4 and 2.05.6(4) <br /> The specific findings required under this section which were made in the <br /> July, 1987 Findings Document (Renewal ) have not been modified by the <br /> proposed revision and those findings remain applicable. <br /> The proposed operation is in compliance with the requirements of this <br /> section. <br /> IV. Geology - Rules 2.04.5 and 2.04.6 <br /> Geologic information supplied by the operator in regard to the area of <br /> proposed PR No. 2 appears on pages 14-16 of Section 2.04.6 of the permit <br /> application package. This information indicates no significant <br /> differences exist between the basic geology of the current permit area <br /> and that of PR No. 2. With the exception noted below, the specific <br /> findings required under this section which were made in the July, 1987 <br /> Findings Document (Renewal ) are applicable to the area of PR No. 2. <br /> Samples of coal waste from the existing storage area at the mine <br /> submitted for analysis by the Division do not indicate the presence of <br /> acid forming, toxic forming or alkalinity producing materials. It is <br /> presumed that the coal and roof and floor rock will exhibit similar <br /> characteristics. <br /> Although proximate analyses of the coal have been submitted by the <br /> operator, complete analyses of the coal seam and associated roof and <br /> floor rock will need to be provided for verification purposes. The <br /> following stipulation is therefore necessary: <br /> Stipulation No. 06: <br /> WITHIN 60 DAYS OF APPROVAL OF PERMIT REVISION (PR) NO. 2, <br /> NATIONAL KING COAL WILL SUBMIT THREE (3) SEPARATE CHEMICAL ANALYSES <br /> THAT CONFORM WITH THE MLRD 1982 GUIDELINES FOR THE COLLECTION OF <br /> BASELINE QUALITY AND OVERBURDEN GEOCHEMISTRY DATA AND ARE <br /> REPRESENTATIVE OF THE COAL TO BE MINED IN PR NO. 2 AND OF THE <br /> ASSOCIATED ROOF AND FLOOR MATERIALS. THE APPROXIMATE GEOGRAPHIC <br /> LOCATIONS OF THESE SAMPLES WILL BE INDICATED ON REVISED COPIES OF <br /> MAP C-10 FOR INCLUSION IN THE PERMIT PACKAGE. <br /> With the acceptance of this stipulation by the operator, the proposed <br /> operation is in compliance with the requirements of this section. <br /> -4- <br />
