Summary <br /> The Review Process <br /> The Division received a complete application for PR No. 2 on January 24, <br /> 1990. Acknowledgement of this was made to the operator on February 8, 1990. <br /> Publication of the proposed permit revision was made February 19 and 26, <br /> March 5 and 12, 1990 in the Durango Herald. Staff comments generated in <br /> regard to adequacy issues identified during review of the proposed revision <br /> were conveyed to National King Coal , Inc. in a letter dated April 4, 1990. A <br /> meeting with the operator in regard to these adequacy issues and the possible <br /> nature of the responses required for approval was held in Division offices <br /> May 3, 1990. The operators' responses to the adequacy summary of April 4, <br /> 1990 were received by the Division on June 7, 1990. <br /> Since the 120th day of the review period was reached June 5, 1990, the review <br /> period was extended an additional 60 days or until August 5, 1990 as permitted <br /> by Rule 2.07.4(6) . As a result of certain deficiencies identified by the <br /> staff during review of the operator's initial adequacy responses, a second <br /> adequacy summary was sent to the operator on June 26, 1990. Revised narrative <br /> and maps in response to this summary were received from the operator July 14, <br /> 1990. Since the major remaining concerns were addressed with this material , <br /> the Division is proposing to approve the application for PR No. 2 with <br /> stipulations. <br /> Although the permit area for the King Coal Mine includes federal acreage, the <br /> proposed PR No. 2 involves only privately owned surface and mineral rights. <br /> No federal resources are directly affected and the application was not <br /> reviewed by the Office of Surface Mining (OSM) . OSM has determined that the <br /> revision would not require a federal mine plan modification. <br /> Description -of the Environment <br /> Please refer to the July 9, 1987 Findings of Compliance (Renewal ) . <br /> Description of the Operation and Reclamation Plans <br /> When the area of proposed PR No. 2 is added, the revised permit area of the <br /> mine will total approximately 889 acres. All of the surface ownership is <br /> private; approximately 400 acres of mineral ownership is federal ; the <br /> remaining 480 acres of mineral ownership is private. The 480 acres added by <br /> PR No. 2 lie adjacent to the current permit area and comprise the SW1/4 SW1/4 <br /> 28, S1/2 SE1/4 29, NE1 /4 NW1/4 32, and E1/2 32, T35N, R11W. <br /> Mining techniques are unchanged from those described in the July 9, 1987 <br /> Findings of Compliance (Renewal ) . Anticipated life of the mine, however, is <br /> estimated to increase to 262 months based on a projected production of <br /> 175,000 t.p.y. <br /> Reclamation will consist of dismantling and removing all structures, <br /> backfilling and sealing the underground portals, regrading the area to achieve <br /> a stable, productive land form, topsoiling, seeding, and mulching. The <br /> proposed post-mining land use is rangeland and wildlife habitat. <br /> -1 - <br />
