XVIII. Coal Processing Waste and Non-Coal Processing Waste - Rules 2.05.3(8), <br /> and 4.11 <br /> Temporary surface storage of limited amounts of the underground waste <br /> generated by the operation and its eventual backstowing in worked out <br /> sections of the mine are practices currently approved for the mine. <br /> Continuation of these practices has been proposed for the future <br /> operation. As a result of recent changes in the regulations of the <br /> Colorado Mined Land Reclamation Board for Coal Mining, however, coal <br /> processing and underground development waste are no longer <br /> differentiated. All such material is considered coal mine waste and <br /> subject to the same regulations. Consequently, the storage and disposal <br /> practices approved for the mine in regard to coal mine waste must be <br /> revised to conform with current rules. Therefore, the following <br /> stipulation is made: <br /> Stipulation No. 07: <br /> WITHIN 90 DAYS OF APPROVAL OF PERMIT REVISION (PR) NO. 2, <br /> NATIONAL KING COAL WILL SUBMIT A PLAN IN THE FORM OF A TECHNICAL <br /> REVISION TO THE PERMIT BOTH ACCEPTABLE TO THE DIVISION AND THAT <br /> PROVIDES FOR THE PERMANENT DISPOSAL OF THE COAL MINE WASTE <br /> GENERATED BY THE MINE. THE PLAN SHALL INCLUDE AN ESTIMATE OF THE <br /> AMOUNT OF COAL MINE WASTE TO BE PRODUCED AND SHALL COMPLY WITH THE <br /> APPLICABLE PORTIONS OF RULES 2.05.3(8), 2.05.3(9), 2.05.300), 4.10 <br /> AND 4.11 . <br /> With the acceptance of this stipulation by the operator, the proposed <br /> operation is in compliance with the requirements of this section. <br /> XIX. Mine Facilities, Coal Handling Structures and Support Facilities; <br /> Roads and Ponds, impoundments and Diversions - Rules .05.3(4), <br /> and 4.U5 <br /> The specific findings required under this section which were made in the <br /> July, 1987 Findings Document (Renewal ) have not been modified by the <br /> proposed revision and those findings remain applicable. <br /> The proposed operation is in compliance with the requirements of this <br /> section. <br /> XX. Bonding - Rules 2.05.4(2) (b) and 3 <br /> The specific findings required under this section which were made in the <br /> July, 1987 Findings Document (Renewal ) have not been modified by the <br /> proposed revision and those findings remain applicable. The addition of <br /> the 480 acres involved in proposed PR No. 2 which will be mined by means <br /> of the extension of current workings does not increase the amount of <br /> surface disturbance of the mine or the cost of its reclamation. <br /> The proposed operation is in compliance with the requirements of this <br /> section. <br /> -10- <br />
