t
NOTICE OF PROPOSED DECISION
The Colorado Mined Land Reclamation Division has approved an application for a
revision (PR - 01 ) to the existing permit to conduct coal mining and
reclamation operations submitted by National King Coal Inc. for the King Coal
Mine.
The King Coal Mine operation is located in in La Plata County, approximately 7
miles southwest of Hesperus , Colorado. The mine is an underground operation
with an anticipated maximum production capacity of 120 ,000 tons per year. The
permit revision incorporates a 60 acre Federal Lease modification into the
mine permit area. The revision will not result in additional surface
disturbance and will not alter the anticipated maximum annual coal
production. The coal to be mined is federally owned, and the surface to be
affected is privately owned. The revised permit area encompasses
approximately 409.0 acres in Sections 29, 30, 31 and 32; T35N, R11W, N.M.P.M.
This proposed approval decision is based on a finding that the proposed
operation will comply with all requirements of the Colorado Surface Coal
Mining Reclamation Act, C.R.S. 34-33-101 , et seq. , and the regulations
promulgated thereunder.
Copies of the proposed decision including stipulations , are on file for public
inspection at the Colorado Mined Land Reclamation Division, Room 215,
Centennial Building, 1313 Sherman Street, Denver, Colorado 80203 and at the
County Clerk 's Office in La Plata County, 1060 E Second Avenue, Durango, CO.
Persons with an interest that may be adversely affected by the proposed
decision may request a formal hearing before the Mined Land Reclamation Board
on the proposed decision. Such request must be made within thirty (30) days
of the initial publication of this notice, must be in writing, and must state
with reasonable specificity the reasons for the request and the objections to
the proposed decision.
3277G
