The <br />Permit authorizes Oxbow Mining LLC to discharge treated wastewater subject to the specific effluent limitations and <br />other conditions of the Permit. Section 61.8, 5 CCR 1002 -61, requires a permittee to comply with all of the terms and <br />conditions of the permit. <br />The Water Quality Control Division (the "Division ") has received your Discharge Monitoring Report(s) ( "DMR ") for <br />the following monitoring period(s). The self - monitoring data you have provided on your DMR(s) indicates <br />noncompliance with the discharge permit condition(s) as indicated below: <br />It is imperative that the necessary steps be taken to maintain compliance with permit conditions at all times. Please <br />reply to this Division, in writing, within fourteen (14) calendar days of the date of this letter as to what action and <br />measures you have or will be taking to abate this condition. <br />This Compliance Advisory is intended to advise you of violations of the Colorado Water Quality Control Act, its <br />implementing regulations, and the Permit, so that you may take appropriate steps to correct our records (if applicable), <br />or to avoid or mitigate fonnal enforcement action. This Compliance Advisory does not constitute a Notice of Violation <br />or Cease and Desist Order and is not subject to appeal. However, the issuance of this Compliance Advisory does not <br />limit or preclude the Division from pursuing its enforcement options concerning the above violation(s).
