Box 536 <br />Pueblo, CO 81002 <br />Re: New Elk Mine (Permit C- 1981 -012), operated by New Elk Coal Company (NECC) <br />Minor Revision No. 112 (MR- 112) — Completeness and Adequacy <br />Expand DWDA by 0.6 acres and move ditches and road <br />Dear Ms. Sword: <br />We have received a minor revision application to revise the New Elk Mine permit to conduct coal <br />mining in Colorado. Our initial review indicates that all preliminary items required by the Colorado <br />Surface Coal Mining Reclamation Act, Section 34 -33 -101 et seq., C.R.S., have been submitted. <br />Thus, the application has been considered complete for the purposes of filing as of April 13, 2012. <br />The Division has reviewed the application to determine whether the items are adequate in terms of <br />meeting the requirements of the Act and Regulations. We also reviewed it to determine if it would <br />be of interest to other agencies. Due to the proximity to State Highway 12, I thought you may wish <br />to comment. <br />Please make any comments so that the Division can issue a decision regarding the application on or <br />before April 23, 2012.
