Linden <br />Trinidad, CO 81082 <br />Re: MSF/Feister Pit #1, Permit No. M-2006-010, 112c Conversion Submittal Deadline <br />Mr. Dorenkamp: <br />On April 2, 2012, the Division of Reclamation, Mining and Safety approved the succession of <br />operators from MS Forest to Las Animas County for this operation. Las Animas County is now <br />the permitted operator of the MSF/Feister Pit #1, and as such, is responsible for all provisions in <br />M- 2006 -010, as well as those specified in the Rules and Regulations. MS Forest is relieved of all <br />responsibilities concerning this operation. <br />Thank you for your diligence thus far by working with the Division and MS Forest. As indicated <br />in the Board's Succession of Operators application forms, a successor to a permit assumes all <br />liability for compliance with the Act, Rules, and permit. The Mined Land Reclamation Board <br />has determined that a conversion to a 112 permit is required to bring the site into compliance. <br />Please submit the 112c conversion application by June 30, 2012 with all materials in approvable <br />form by September 30, 2012. Until the conversion application is received and approved, the <br />operation remains in violation, pursuant to C.R.S. section 34- 32.5 -124.
