The Division of Reclamation, Mining and Safety (Division /DRMS) received a Transfer of Permit and
Succession of Operators Application Form (50-02) from Martin Marietta with Option B selected
for the Greeley 35 Ave Pit. By selecting Option B, Martin Marietta choose to not waive their
right to a 30 -day processing period and was required to submit a replacement Financial
Warranty for the same dollar amount maintained by the current Operator. The Division
approved the Transfer of Permit and Succession of Operators application for the Greeley 35
Ave Pit on February 15, 2012.
The Division is required to recalculate the reclamation bond within 60 -days (April 15, 2012)
from the date of the transfer. The Division updated the most recent bond calculation (AM -01)
to include the cost to install slurry walls around the five (5) unlined lakes created by the mining
operation. The revised financial warranty amount is $4,546,572.00, which is an increase of
$3,578,783.00.
Martin Marietta will have 60 -days (June 5, 2012) from the date of this letter to submit a rider or
a new financial warranty per Rule 4.2. If you wish to submit a different type of Financial
Warranty, the various application forms can be found at the following website:
