Compliance With Mine Plan N - Support Facilities Not On -site <br />N - Other N - Special Categories Of Mining <br />N - Processing Waste N - Topsoil <br />COMMENTS <br />INTROCUCTION — This was a partial inspection of the Bear No. 3 Mine conducted by Brock Bowles of the <br />Colorado Division of Reclamation, Mining and Safety on March29, 2012. There was not a company <br />representative present for the inspection. Weather conditions were clear and warm with a light breeze and the <br />soil conditions were damp. <br />AIR RESOURCE PROTECTION — Rule 4.17: <br />There was no problem with fugitive dust coming off the site or disturbed areas. <br />FISH and WILDLIFE — Rule 4.18: <br />Many elk tracks were seen around the area of the hillside seep and a frog was seen jumping onto the seep <br />discharge water. <br />HYDROLOGIC BALANCE - Rule 4.05 Drainage Control 4.05.1, 4.05.2, 4.05.3; Siltation Structures 4.05.5, <br />4.05.6; Discharge Structures 4.05.7, 4.05.10; Diversions 4.05.4; Effluent Limits 4.05.2; Ground Water <br />Monitoring 4.05.13; Surface Water Monitoring 4.05.13; Drainage — Acid and Toxic Materials 4.05.8; <br />Impoundments 4.05.6, 4.05.9; Stream Buffer Zones 4.05.18: <br />The hillside spring continues to flow into the constructed ditch to the treatment pond (photo 1). The <br />treatment pond was discharging to the NPDES discharge point and the water was its usual orange color (photo 2). <br />The sediment pond had some standing water in the lower portion of the pond where the cattails are growing. The <br />upper, north part of the pond was dry. The primary discharge gate was closed. There was no blockage at the <br />pipe's outlet. The berm along side of the sediment pond collection ditch appeared to be stable. <br />The North Fork of the Gunnison River was very muddy and appeared to be higher than at the last inspection, most <br />likely due to runoff. <br />Number of Partial Inspection this Fiscal Year: 6 <br />Number of Complete Inspections this Fiscal Year: 3 <br />Page 2 of 5 <br />
