Conditions for the Protection of non - mineral surface resources on USFS lands, associated with Oxbow <br />Mining's MR -99 <br />Administrative <br />1. The Paonia District Ranger must be notified 48 hours in advance that heavy equipment will be <br />moved onto National Forest System lands and that surface disturbing activities will commence. <br />2. All or parts of the following lands encompassed in this lease are in an Inventoried Roadless Area. <br />Per stipulations on COC- 61357, these lands shall be subject to all future rules and regulations of <br />the Secretary of Agriculture concerning management of roadless areas including restrictions on <br />road building. Before any road construction or reconstruction takes place, Oxbow must ensure <br />compliance with these rules and regulations through coordination and verification with the <br />USFS. <br />3. All final locations of drill pads and new temporary road alignments must be accepted in the field <br />by the Paonia District Ranger or his /her representative before any ground disturbance or <br />construction begins. <br />4. Staging areas on NFS lands must be accepted in advance by the Paonia District Ranger. <br />5. All surface disturbing activities including reclamation must be supervised by a responsible <br />representative of the Lessee /Operator who is aware of the terms and conditions of the project <br />permits and conditions. <br />Range Management, Livestock, Recreation, Timber and Noxious weeds <br />6. Harassment of livestock and wildlife is prohibited. If stock is in the project area, extra <br />precautions must be taken by the operator and their contractors to ensure that stock are not <br />pushed out of the currently occupied grazing unit. <br />7. The Operator will be responsible to repair or replace all damage to fences, cattle guards, <br />resource improvements, roads, and other structures on NFS lands that result from their <br />operations. The Forest Service must be notified of damages as soon as possible. <br />8. Reserve /mud pits will be enclosed by a construction -type or barbed -wire fence, or other type of <br />barricade approved by the Forest Service, until they are dry. <br />9. If merchantable timber is to be removed for constructing drill pads and roads, a timber contact <br />is required to ensure that tree removal follows USDA -FS timber management practices. <br />10. Drilling and construction equipment (except for personnel conveyance) will not be mobilized on <br />or off the project area during the two days prior, on opening day, or on weekends during <br />muzzleloader and the first two rifle hunting seasons, unless otherwise allowed by the District <br />Ranger. <br />11. All heavy equipment and drilling equipment will be washed, and free of mud, debris, etc, prior <br />to entering NFS lands. <br />
