Janet Binns <br />The access road and shaft construction site are located in an industrial area so no reclamation is <br />required as per Rule 4.15.10(3). See discussion on page 2.05 -46. <br />The equipment lay down area for shaft construction is within 100 feet of the Purgatorie River. <br />Rule 4.15.18 roughly states that no land within 100 feet of a perennial stream shall be disturbed <br />by surface and underground coal mining operations unless the Division specifically authorizes <br />surface or underground mining operations closer to, or through such a stream upon finding that <br />surface coal mining operations will not cause or contribute to the violation of applicable water <br />quality standards and during and after mining, the water quantity and quality, and other <br />environmental resources of the stream shall not be adversely affected. <br />The equipment lay down area was previously disturbed by the abandoned rail corridor so it is <br />possible this rule does not apply. In any case, construction of a containment area and run -off <br />containment berm should assure the DRMS that the activity will not cause or contribute to the <br />violation of applicable water quality standards. Restoring the land to approximate original <br />contour will minimize or eliminate erosion. Little run -off leaves this relatively flat industrial <br />site. Wind erosion is minimized by gravel surfacing of the access road and rail beds. <br />The access road that runs to the west mine was changed to a haul road in anticipation of hauling <br />material to the west DWDA. <br />Data enclosed to support this technical revision are listed below. <br />Sincerely, <br />J.
